1. Acceptance of Terms

By accessing algarvecreativelab.pt or using our services, you agree to be bound by these Terms and Conditions. These terms apply to all visitors, users, and clients of Algarve Creative Lab.

2. Services Provided

Algarve Creative Lab provides:

* Website and Landing Page Design.

* AI Chatbot Development (WhatsApp & Web).

* AI Content Creation (Video, Image, and Text).

3. AI Usage & Accuracy Disclaimer

* Probabilistic Nature: You acknowledge that our services utilize Artificial Intelligence. AI models are probabilistic and may occasionally produce inaccurate information ("hallucinations").

* Final Review: The Client is responsible for the final review and approval of all AI-generated content or chatbot logic before it is published or used in a live business environment.

* Liability: Algarve Creative Lab shall not be held liable for errors, misinformation, or damages resulting from the use of AI-generated content.

4. Third-Party Platforms (WhatsApp/Meta)

* Compliance: For WhatsApp Bot services, the Client must comply with Meta’s WhatsApp Business Policy.

* Service Outages: We are not responsible for service interruptions caused by third-party providers (e.g., Meta, OpenAI, or Hosting services).

* API Costs: Any third-party costs (such as Meta’s per-conversation fees) are the sole responsibility of the Client unless otherwise stated in a written agreement.

5. Intellectual Property

* Transfer of Ownership: Upon full payment of the agreed-upon project fee, the ownership of the final website and specific media assets is transferred to the Client.

* Portfolio Rights: Algarve Creative Lab retains the right to display the completed work in our portfolio and marketing materials unless a Non-Disclosure Agreement (NDA) is signed.

6. Payments and Refunds

* Methods: We accept Bank Transfer, Multibanco, and MB Way.

* Deposits: A non-refundable deposit (typically 50%) is required to begin work on any project.

* Cancellations: If a project is cancelled by the Client after work has commenced, Algarve Creative Lab reserves the right to charge for the hours already invested.

7. Alternative Dispute Resolution (RAL)

In accordance with Law No. 144/2015, in the event of a dispute, consumers in the Algarve region may resort to:

8. Governing Law

These terms are governed by and construed in accordance with the laws of Portugal. Any disputes shall be settled in the courts of Faro.
